These Terms of Service govern your use of Aspera. By using the app you agree to these terms. If you don't agree, please don't use Aspera.
Aspera ("we," "us," "our") is operated by David Sharpe. Aspera is an identity-based discipline app that helps you build lasting habits by proving daily progress against personal goals. Contact: davidbsharpe@icloud.com.

By creating an account, downloading, or using Aspera, you agree to be bound by these Terms of Service and by our Privacy Notice. These terms form a legal agreement between you and David Sharpe (doing business as Aspera). If you are using Aspera on behalf of another person or entity, you represent that you have the authority to bind them to these terms.
You must be at least 13 years old to use Aspera. If you are under the age of majority in your jurisdiction, you may only use Aspera with the involvement of a parent or legal guardian. By using the app, you represent that you meet these requirements and that you have the legal capacity to enter into these terms.
To use most features of Aspera you'll need an account. You agree to provide accurate, complete, and current information when registering, and to keep that information up to date. You are responsible for safeguarding your password and for any activity that occurs under your account. Notify us immediately at davidbsharpe@icloud.com if you suspect unauthorised access. We are not liable for losses caused by unauthorised use of your account where you have failed to keep your credentials secure.
Subject to these terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use Aspera for your personal, non-commercial use. You agree to use the service only as intended and in compliance with all applicable laws. We may add, remove, or change features at any time without notice.
Aspera lets you create, log, and store content — goals, daily proofs, reflections, ratings, and notes ("User Content"). You retain ownership of your User Content. By using Aspera you grant us a worldwide, royalty-free, non-exclusive licence to host, store, reproduce, and process your User Content solely as needed to operate and improve the service.
You are solely responsible for your User Content and for the consequences of submitting it. You represent that you have all necessary rights to the content you submit and that it does not violate the rights of any third party or any law.
Aspera and all related software, design, text, graphics, logos, and other materials are owned by David Sharpe or licensed to us, and are protected by intellectual-property laws. Except for the limited licence granted in section 4, nothing in these terms transfers any right, title, or interest in Aspera to you. The "Aspera" name, logo, and visual identity are our trademarks; you may not use them without prior written consent.

Aspera may offer free and paid features. If we introduce paid subscriptions, the applicable price, billing cycle, and renewal terms will be disclosed at the point of purchase. Payments made through the Apple App Store or Google Play are subject to those platforms' terms; refunds are handled according to their policies. We reserve the right to change prices for paid features with reasonable notice.
Aspera relies on third-party service providers, including Supabase (authentication, database, infrastructure) and PostHog (analytics). Their use of your personal information is governed by our Privacy Notice and the providers' own terms. Aspera may also link to or interoperate with third-party services we don't own or control. We are not responsible for the content, policies, or practices of any third-party service.
You may stop using Aspera and delete your account at any time from within the app or by emailing us. We may suspend or terminate your access to Aspera at any time, with or without notice, if we reasonably believe you have violated these terms or if doing so is necessary to protect the service, other users, or us. Upon termination, your right to use the service ceases immediately. Sections that by their nature should survive termination (intellectual property, disclaimers, limitations of liability, indemnification, governing law) will survive.
Aspera is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. We do not warrant that the service will be uninterrupted, secure, error-free, or that defects will be corrected.
Aspera is a productivity and habit-tracking tool. It is not a substitute for professional medical, mental-health, fitness, financial, or legal advice. Always consult a qualified professional regarding decisions that affect your health, finances, or wellbeing. You use Aspera at your own risk.
To the fullest extent permitted by law, in no event will David Sharpe, our affiliates, or our service providers be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of, or inability to use, the service; (b) any unauthorised access to or use of our servers and any personal information stored therein; (c) any interruption or cessation of transmission to or from the service; or (d) any other matter relating to the service.
Where liability cannot be excluded by law, our aggregate liability to you for all claims arising out of or relating to the service is limited to the greater of (i) the amount you paid to us for use of Aspera in the twelve (12) months preceding the event giving rise to the claim, or (ii) USD $50.
You agree to defend, indemnify, and hold harmless David Sharpe and our affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with (a) your access to or use of the service; (b) your User Content; or (c) your violation of these terms or any applicable law.
We may modify or discontinue Aspera, or any feature of it, at any time. We may also update these terms from time to time. The updated version will be indicated by an updated "Last updated" date at the top of this page. Material changes will be communicated through the app or by direct notification. Your continued use of Aspera after changes take effect constitutes your acceptance of the new terms.
These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. The exclusive venue for any dispute that is not subject to arbitration will be the state or federal courts located in New York County, New York, and you consent to personal jurisdiction in those courts.
If you are a consumer in the European Union, the United Kingdom, or another jurisdiction whose mandatory consumer-protection laws override the choice of law above, those mandatory laws will apply to the extent required.
